Temporary local planning instruments

A local government may prepare a temporary local planning instrument (TLPI) to respond to changing and emerging planning issues.

A TLPI deals with a specific, often localised issue. Once made, local government is allowed time (up to two years) to incorporate a TLPI into their local planning scheme (if required).

For example, a TLPI may be used to provide:

  • protection for a building of cultural heritage, pending its listing on a local heritage register
  • requirements for development in areas recently affected by disasters, such as flooding, until provisions can be included in the local planning scheme.

Where a local government has made a TLPI, you are able to view it on the local government’s website or on the department’s plan-making dashboard.

The Planning Minister can also make a TLPI under the Planning Act to protect, or give effect to, a state interest. Below are the TLPIs made by the Planning Minister:

  • On 9 August 2024 , the Planning Minister amended Temporary Local Planning Instrument No. 2 of 2023 (Kurilpa Sustainable Growth Precinct) for the Brisbane City Council local government area.

  • On 4 September 2024, the Planning Minister made Temporary Local Planning Instrument No. 1 of 2024 (Arundel Hills) for the City of Gold Coast local government area.

    Please note: while the Statement of Reasons refers to the Planning Minister’s decision under section 27 of the Planning Act 2016 to intend to make TLPI No. 2 of 2023, the Planning Minister considered and relied on the same reasons in his decision to make TLPI No. 2 of 2023.

  • On 3 July 2020, the Planning Minister made temporary local planning Instrument No. 1 of 2020 (Narangba Innovation Precinct East) for the Moreton Bay Regional Council local government area.

  • On 30 May 2019, the Planning Minister made temporary local planning instrument No. 1 of 2019 (Bargara Building Height and Sea Turtle Sensitive Area) for the Bundaberg Regional Council local government area.

    A statewide Sea Turtle Sensitive Area Model Code has also been released providing councils with a set of provisions to protect sea turtles from new development along the coastline.
